Harnett Co. gun range stops all rifle activities after judge's ruling

All rifle activities have been stopped at a Harnett County shooting range after a judge said the range was not protected under certain state rules.

The owners of Drake’s Landing, Dan and Linda Andrews, said rifle range activities have been “taken out of commission” but the pistol and clay shooting activities will remain in place.

The Andrews said clay shooting will expand into the vacant rifle range.

On March 17, Superior Court Judge Winston Gilchrist ruled Drake’s Landing could not operate under the state’s agritourism laws.

Gilchrist said that the General Assembly "did not intend to include continental shooting towers, 3D archery courses and ranges, sporting clay, skeet and trap ranges, rifle ranges and pistol pits within the definition of 'agriculture.'"

Under the state's agritourism law, a farm can engage in a number of money-raising activities without county zoning approval.

Neighbors argued Drake Landing should be regulated like a shooting range and should not be classified under the state's agritourism label because that exempts it from local zoning. But until last month, those appeals had been squashed on the basis that the business contended that hunting and shooting are traditional farm activities.

Some homeowners who live near the facility have reported bullets striking their houses, while others said the gunfire was inappropriate for areas as populated as their neighborhood.

Drake’s Landing had until Wednesday to appeal the judge’s decision.
