Durham mother turns herself in, 2 missing boys OK

DURHAM, N.C. -

Durham police said a woman who took her two children unlawfully from their school turned herself in to Carrboro police Tuesday. Police said both of the boys were unharmed.

Daniel Isai Banegas Diaz and Jeremias Isaac Banegas Diaz were reported missing Tuesday late morning. The boys were allegedly taken from Hillandale Elementary School.

Sgt. Jeff Gordon, with the North Carolina Highway Patrol, said the case did not meet the "imminent danger" criteria that is required to issue an Amber Alert.

Authorities confirmed the children never entered the school Tuesday.

The mother, 46-year-old Selma Diaz, is charged with felony abduction of children.

Court documents show that Diaz's husband, Roberto Banegas, filed for and was granted emergency custody of the children on April 26. A new document to uphold the April ruling was file Wednesday, Oct. 2.

Banegas alleged that his wife suffered from bipolar disorder and she left the couple's home with the children during a time when she had not been taking medication on a regular basis. He also said she threatened to kill herself in March 2013 by jumping in front of traffic with the eldest child in her arms.

Banegas told the court that he was concerned for the safety and well-being of the children.

Jenny Rodriguez, a neighbor of Selma Diaz, said she was "in shock" over what happened.

"I knew this lady. She used to live downstairs and it just surprised me that she did this," Rodriguez said.
