Here's a quick look at your Top 3 on 3 stories you'll need to know before heading out this morning.

Senator Ted Cruz, a Republican from Texas, conducted a pseudo filibuster Tuesday afternoon, evening, and into Wednesday morning. It is not a true filibuster which takes place to prevent a vote, but the senate will take a procedural vote on the budget resolution at midday today. Senator Cruz wants his message heard, that the senate should follow the house's lead and de fund Obamacare. Meantime, The House of Representatives will be in session this afternoon and remain in session throughout the week.

Also, NBC News has obtained exclusive video of the frightening moments right after militants stormed a Nairobi Mall. Part of the video shows a mother and her kids lying still, playing dead on the floor in terror. Then, a plain-clothed officer then approaches them and whisks them to safety. The rest of the video shows terrified shoppers scrambling to get out as police officers keep them moving. Soldiers are also seen scoping the mall for the gunmen. More than 60 people died in the attack, on Tuesday, the Kenyan Government confirmed that five of the militants were killed and 11 were captured.

Plus, Savannah Metro Police are still trying to identify a body pulled from the Savannah River on Tuesday morning. Detectives say they believe it could be a man who witnesses reported seeing fall into the water on Sunday. Officials say the body was found floating near the same spot where the man was last seen. Strong water current prevented divers from searching that area the man was said to have fallen in.
