Norfolk Southern Railway sued by EEOC

ATLANTA, Ga. -

   The U.S. Equal Employment Opportunity Commission has filed a lawsuit in Atlanta against Norfolk Southern Railway Company for allegedly discriminating against an employee because of his disability.

   According to the suit, Norfolk Southern violated federal law by not allowing an employee to return to work after receiving treatment for his disability, degenerative disc disorder, and being cleared by his physician to return to work.

   The EEOC charges that Norfolk Southern's medical director disregarded the treating physician's opinion and determined the employee was medically disqualified from working without ever examining him.  The company subsequently fired the employee.

   The EEOC is seeking reinstatement, back pay and compensatory and punitive damages for the employee as well as injunctive relief to prevent future discrimination.
