BREAKING: Stepfather Convicted of Deprivation of Minor

HINESVILLE, GA -

Hinesville's District Attorney says a man whose stepson died in a coastal Georgia swamp has been convicted of deprivation of a minor.
    
Brian Gale and his 15-year-old stepson, Daniel Clark Head went turkey hunting back in March 2010 when they got lost in the woods.

Gale told investigators he went to look for help and Clark was too weak to walk.

When rescuers got back to Clark, the teen was later found face-down in about 12 to 18 inches of water.

DA Tom Durden tells News 3 Gale was sentenced to 5 months probation, but no jail time.

Brian Gale was originally convicted of Voluntary Manslaughter in October of 2012, and sentenced to five years in prison.

But during the trial, a juror allegedly sent text messages to the victim's family and a witness.

The defense argued that contact was grounds for a new trial, and a judge agreed.
